มาตรา 38
- ภายในบังคับแห่งบทบัญญัติทั้งหลายต่อไปนี้ หญิงมีสามี ถ้ามิได้รับอนุญาตของสามี หาอาจทำการอันหนึ่งอันใดที่จะผูกพันสินบริคณห์ได้ไม่
- การใดอันกระทำลงฝ่าฝืนบทบัญญัติอันนี้ ท่านว่าเป็นโมฆียะ
Section 38. (Draft in English from Vol.79)
- [I] Subject to the following provisions a married woman cannot, without the permission of her husband, do any act binding the joint property (Sin borikon).

- [I] A wife must have permission to do any of the acts mentioned below:-
- (1) To do acts mentioned in Nos. 1-6 of Paragraph I of Art. 12;
- (2) To accept or refuse a donation (gift) or legacy;
- (3) To make a contract putting her under any corporal restraint.
- [II] Any acts contrary to the provisions of the preceding paragraph may be annulled.

- [I] Under the general community of goods the property of the husband and the property of the wife become the common property of both spouses (i.e., common property). Common property includes also any property which he or she acquires during the subsistence of the community of goods.

- [III] If a right which has been, or may be, entered in the land register becomes common property, either spouse may require the other to concur in rectifying the land register.

- [I] That which the husband or the wife acquires during the subsistence of the community of income and profits becomes the common property of both spouses (i.e., common property).
