• ถ้าคู่สัญญาไม่ได้กำหนดเวลากันไว้ว่าจะพึงคืนทรัพย์สินซึ่งฝากนั้นเมื่อไรไซร้ ผู้รับฝากอาจคืนทรัพย์สินนั้นได้ทุกเมื่อ
