มาตรา 973

• เมื่อกำหนดเวลาจำกัดซึ่งจะกล่าวต่อไปนี้ได้ล่วงพ้นไปแล้ว คือ
  • (๑) กำหนดเวลาสำหรับยื่นตั๋วแลกเงินชนิดให้ใช้เงินเมื่อได้เห็น ฤๅในระยะเวลาอย่างใดอย่างหนึ่งภายหลังได้เห็น
  • (๒) กำหนดเวลาสำหรับทำคำคัดค้านการไม่รับรองฤๅการไม่ใช้เงิน
  • (๓) กำหนดเวลาสำหรับยื่นตั๋วเพื่อให้ใช้เงิน ในกรณีที่มีข้อกำหนดว่า "ไม่จำต้องมีคำคัดค้าน"
• ท่านว่าผู้ทรงย่อมสิ้นสิทธิที่จะไล่เบี้ยเอาแก่เหล่าผู้สลักหลัง ผู้สั่งจ่าย และคู่สัญญาอื่น ๆ ผู้ต้องรับผิด เว้นแต่ผู้รับรอง
• อนึ่ง ถ้าไม่ยื่นตั๋วแลกเงินเพื่อให้เขารับรองภายในเวลาจำกัดดังผู้สั่งจ่ายได้กำหนดไว้ ท่านว่าผู้ทรงย่อมเสียสิทธิที่จะไล่เบี้ยทั้งเพื่อการที่เขาไม่ใช้เงิน และเพื่อการที่เขาไม่รับรอง เว้นแต่จะปรากฏจากข้อกำหนดว่า ผู้สั่งจ่ายหมายเพียงแต่จะปลดตนเองให้พ้นจากประกันการรับรอง
• ถ้าข้อกำหนดจำกัดเวลายื่นตั๋วแลกเงินนั้นมีอยู่ที่คำสลักหลัง ท่านว่าเฉภาะแต่ผู้สลักหลังเท่านั้นจะอาจเอาประโยชน์ในข้อกำหนดนั้นได้

• [I] After the expiration of the limits of time fixed:
  • (1) For the presentment of a bill of exchange payable at sight or at a certain time after sight;
  • (2) For drawing up the protest for non-acceptance or non-payment;
  • (3) For presentment for payment in the case of a stipulation "protest not necessary";
• [II] the holder loses his rights or recourse against the indorsers, against the drawer, and against the other parties liable, with the exception of the acceptor.
• [III] In default of presentment for acceptance within the limit of time stipulated for by the drawer, the holder loses his right of recourse for non-payment, as well as for non-acceptance, unless it appears from the terms of the stipulation that the drawer meant only to release himself from the guarantee of acceptance.
• [IV] If the stipulation for a limit of time for presentment is contained in an indorsement, the indorser only can avail himself of it.
