มาตรา 229
  • การรับช่วงสิทธิย่อมมีขึ้นด้วยอำนาจกฎหมาย และย่อมสำเร็จเป็นประโยชน์แก่บุคคลดังกล่าวต่อไปนี้ คือ
    • (๑) บุคคลซึ่งเป็นเจ้าหนี้อยู่เอง และมาใช้หนี้ให้แก่เจ้าหนี้อีกคนหนึ่ง ผู้มีสิทธิจะได้รับใช้หนี้ก่อนตน เพราะเขามีบุริมสิทธิ หรือมีสิทธิจำนำจำนอง
    • (๒) บุคคลผู้ได้ไปซึ่งอสังหาริมทรัพย์ใด และเอาเงินราคาค่าซื้อใช้ให้แก่ผู้รับจำนองทรัพย์นั้นเสร็จไป
    • (๓) บุคคลผู้มีความผูกพันร่วมกับผู้อื่น หรือเพื่อผู้อื่นในอันจะต้องใช้หนี้ มีส่วนได้เสียด้วยในการใช้หนี้นั้น และเข้าใช้หนี้นั้น

  • Subrogation takes place by operation of law and ensues to the benefits of the following persons:
    • (1) The person who being himself a creditor pays another creditor who has priority to him owing to such other creditor having a preferential right, pledge or mortgage.
    • (2) The person who, when he acquires an immovable property, uses the purchase price in paying off the persons who have mortgages thereon.
    • (3) The person who, being bound with others or for others to pay a debt, and was interested in paying the same, has paid it.

The most plausible model for this section would be:

  • Civil Code of Brazil (1916), Art.985;
    • Subrogation occurs, by operation of law {de plena direito), in favor:
      • I. Of the creditor who pays the debt of the common debtor to the creditor who was entitled to the right of preference.
      • II. Of the grantee (adquirente) of the mortgaged immovable, who pays the mortgage creditor.
      • III. Of the interested third person, who pays the debt for which he was or might be obligated, in whole or in part.

The other miscellaneous source is as follows:

  • French Civil Code (1804), Art.1251;
    • Substitution takes place absolutely,
      • 1st. For his benefit who being himself a creditor pays another creditor who has a preferable claim on account of his privileges or mortgages ; ,
      • 2d. For the benefit of the purchaser of an immoveable, who employs the value of his purchase in payment of creditors to whom such estate was mortgaged ;
      • 3d. For his benefit who being bound with others or for others for the payment of the debt, had interest in discharging it ;
      • 4th. For the benefit of the beneficiary heir who has paid out of his own funds the debts of the succession.
