มาตรา 314

• อันการชำระหนี้นั้น ท่านว่าบุคคลภายนอกจะเป็นผู้ชำระก็ได้ เว้นแต่สภาพแห่งหนี้จะไม่เปิดช่องให้บุคคลภายนอกชำระ หรือจะขัดกับเจตนาอันคู่กรณีได้แสดงไว้
• บุคคลผู้ไม่มีส่วนได้เสียด้วยในการชำระหนี้นั้น จะเข้าชำระหนี้โดยขืนใจลูกหนี้หาได้ไม่

• [I] Performance of an obligation may be made by any third person, unless its nature does not admit of it, or the parties concerned have declared a contrary intention.
• [II] A person who has no interest in the performance, cannot make performance against the will of the debtor.

  • [I] An obligation may be discharged by a third person except when the nature of the obligation does not permit, or when the parties concerned have expressed a contrary intention.
