มาตรา 40
- หญิงมีสามีอาจทำพินัยกรรม์ว่าด้วยส่วนของตนในสินบริคณห์ได้ มิพักต้องได้อนุญาตของสามี
Section 40. (Draft in English from Vol.79)
- A married woman can, without the permission of her husband, make a will dealing with per portion of the Common property.

- The wife may make a will without the authority of her husband.
- Art.905:
- [I] A married woman cannot make donation during life without the assistance or the special consent of her husband, or without being thereto authorised by the law, conformably to what is prescribed by articles 217 and 219 under the title ''Of Marriage."
