มาตรา 1045

• ถ้าหุ้นส่วนของผู้ใดได้กำหนดแต่เพียงข้างฝ่ายกำไรว่าจะแบ่งเอาเท่าไร ฤๅกำหนดแต่เพียงข้างขาดทุนว่าจะยอมขาดเท่าไรฉะนี้ไซร้ ท่านให้สันนิษฐานไว้ก่อนว่าหุ้นส่วนของผู้นั้นมีส่วนกำไร และส่วนขาดทุนเปนอย่างเดียวกัน

• If the share of a partner is fixed only as to profits or only as to losses, the proportion is presumed to be the same for profits and losses.
