มาตรา 429
- บุคคลใดแม้ไร้ความสามารถเพราะเหตุเป็นผู้เยาว์หรือวิกลจริตก็ยังต้องรับผิดในผลที่ตนทำละเมิด บิดามารดาหรือผู้อนุบาลของบุคคลเช่นว่านี้ย่อมต้องรับผิดร่วมกับเขาด้วย เว้นแต่จะพิสูจน์ได้ว่าตนได้ใช้ความระมัดระวังตามสมควรแก่หน้าที่ดูแลซึ่งทำอยู่นั้น

- A person, even though incapacitated, on account of minority or unsoundness of mind, is liable for the consequences of his wrongful act. The parents of such person are, or his guardian is, jointly liable with him, unless they or he can prove that proper care in performing their or his duty of supervision has been exercised.

- [II] ถ้าบุคคลผู้ไร้ความสามารถนั้นตกอยู่ในความพิทักษ์รักษาของครูบาอาจารย์ ฤๅของมูลนายผู้จ้าง ฤๅบุคคลอื่นใดอยู่เป็นนิตย์ก็ดี ฤๅอยู่เป็นครั้งเป็นคราวก็ดี เมื่อบุคคลผู้ไร้ความสามารถทำละเมิดต่อท่านในเวลาที่อยู่ในความพิทักษ์รักษาของเขาฉะนี้ ท่านว่าครูบาอาจารย์ มูลนายผู้จ้าง ฤๅบุคคลอื่นนั้น ย่อมจะต้องรับผิดร่วมด้วย ถ้าอาจพิศูจน์ได้ว่าครูบาอาจารย์ มูลนายผู้จ้าง ฤๅบุคคลอื่นเช่นว่านั้นมิได้ใช้ความระมัดระวังเพียงพอ และสมแก่หน้าที่ดูแลซึ่งตนทำอยู่

- [I] Persons with capacity of judgment, but minors or incapacitated, can obligate themselves in their transactions only with the consent of their legal representatives. Without this consent they may accept voluntary benefits and exercise rights belonging to them by reason of # their personality.

- [I] Aus Billigkeit kann der Richter auch eine nicht urteilsfähige Person, die Schaden verursacht hat, zu teilweisem oder vollständigem Ersatze verurteilen.
- [II] Hat jemand vorübergehend die Urteilsfähigkeit verloren und in diesem Zustand Schaden angerichtet, so ist er hiefür ersatzpflichtig, wenn er nicht nachweist, dass dieser Zustand ohne sein Verschulden eingetreten ist.
