มาตรา 659

• ถ้าการรับฝากทรัพย์เป็นการทำให้เปล่าไม่มีบำเหน็จไซร้ ท่านว่าผู้รับฝากจำต้องใช้ความระมัดระวังสงวนทรัพย์สินซึ่งฝากนั้นเหมือนเช่นเคยประพฤติในกิจการของตนเอง
• ถ้าการรับฝากทรัพย์นั้นมีบำเหน็จค่าฝาก ท่านว่าผู้รับฝากจำต้องใช้ความระมัดระวังและใช้ฝีมือเพื่อสงวนทรัพย์สินนั้นเหมือนเช่นวิญญูชนจะพึงประพฤติโดยพฤติการณ์ดังนั้น ทั้งนี้ย่อมรวมทั้งการใช้ฝีมืออันพิเศษฉะเพาะการในที่จะพึงใช้ฝีมือเช่นนั้ด้วย
• ถ้าและผู้รับฝากเป็นผู้มีวิชาชีพฉะเพาะกิจการค้าขายหรืออาชีวะอย่างหนึ่งอย่างใด ก็จำต้องใช้ความระมัดระวังและใช้ฝีมือเท่าที่เป็นธรรมดาจะต้องใช้และสมควรจะต้องใช้ในกิจการค้าขายหรืออาชีวะอย่างนั้น

• [I] If the deposit is undertaken gratuitously the depositary is bound to exercise as much care of the property deposited as he is accustomed to exercising in his own affairs.
• [II] If the deposit is undertaken with remuneration the depositary is bound to exercise such care and skill as a person of ordinary prudence would exercise in the circumstance. This includes the exercise of special skill where such skill is required.
• [III] If the depositary professes a particular trade, business or calling, he is bound to exercise the degree of care and skill usual and requisite in such trade, business or calling.
