หมวด ๕ สิทธิและหน้าที่ของผู้รับโอนทรัพย์สินซึ่งจำนอง

มาตรา 738

• ผู้รับโอนซึ่งประสงค์จะไถ่ถอนจำนอง ต้องบอกกล่าวความประสงค์นั้นแก่ผู้เป็นลูกหนี้ชั้นต้น และต้องส่งคำเสนอไปยังบรรดาเจ้าหนี้ที่ได้จดทะเบียน ไม่ว่าในทางจำนองหรือประการอื่น ว่าจะรับใช้เงินให้เป็นจำนวนอันสมควรกับราคาทรัพย์สินนั้น
• คำเสนอนั้นให้แจ้งข้อความทั้งหลายต่อไปนี้ คือ
• (๑) ตำแหน่งแหล่งที่และลักษณะแห่งทรัพย์สินซึ่งจำนอง
• (๒) วันซึ่งโอนกรรมสิทธิ์
• (๓) ชื่อเจ้าของเดิม
• (๔) ชื่อและภูมิลำเนาของผู้รับโอน
• (๕) จำนวนเงินที่เสนอว่าจะใช้
• (๖) คำนวณยอดจำนวนเงินที่ค้างชำระแก่เจ้าหนี้คนหนึ่ง ๆ รวมทั้งอุปกรณ์และจำนวนเงินที่จะจัดเป็นส่วนใช้แก่บรรดาเจ้าหนี้ตามลำดับกัน
• อนึ่ง ให้คัดสำเนารายงานจดทะเบียนของเจ้าพนักงานในเรื่องทรัพย์สินซึ่งจำนองนั้น อันเจ้าพนักงานรับรองว่าเป็นสำเนาถูกถ้วน สอดส่งไปด้วย

Section 738. (Draft in English from Vol.93)

• [I] The transferee who wishes to remove the mortgage must notify the principal debtor and make an offer to every registered creditor whether by way of mortgage or otherwise to pay a reasonable amount corresponding to the value of the property.
• [II] The offer shall contain the following particulars:
• (1) The place and description of the mortgaged property.
• (2) The date of transfer of ownership.
• (3) The name of the former owner.
• (4) The name and domicile of the transferee.
• (5) The sum offered.
• (6) A calculation of the total amount due to each of the creditors including accessories, and the sums which would be distributed to them according to their respective ranks.
• [III] A certified copy of the entries in the official register referring to the mortgaged property shall be enclosed.
