- บุคคลวิกลจริตผู้ใด ถ้าภริยาสามีก็ดี ผู้บุพการี กล่าวคือ บิดามารดา ปู่ย่า ตายาย ทวดก็ดี ผู้สืบสันดาน กล่าวคือ ลูก หลาน เหลน ลื้อก็ดี ผู้อนุบาล หรือผู้พิทักษ์ก็ดี หรือพนักงานอัยยการก็ดี ร้องขอต่อศาลแล้ว ศาลจะสั่งให้บุคคลผู้นั้นเป็นคนไร้ความสามารถก็ได้
