มาตรา 64
- ถ้าบุคคลได้ไปจากภูมิลำเนาหรือถิ่นที่อยู่ และตราบเท่าเจ็ดปีไม่มีใครทราบแน่ว่าเป็นตายร้ายดีอย่างไร เมื่อผู้ใดผู้หนึ่งซึ่งมีส่วนได้เสีย หรือพนักงานอัยยการร้องขอต่อศาลๆ จะสั่งให้บุคคลเช่นนั้นเป็นคนสาบศูนย์ก็ได้
- วิธีเดียวกันนี้ ท่านให้ใช้ตลอดถึงบุคคลซึ่งได้ไปถึงสมรภูมิ์แห่งสงคราม หรือไปตกอยู่ในเรือเมื่ออับปาง หรือไปตกต้องในฐานทีจะเป็นภยันตรายแก่ชีวิตประการอื่นใด หากนับแต่เวลาเมื่อสงครามได้สิ้นสุดลงแล้ว หรือนับแต่เมื่อเรืออับปาง หรือนับแต่เมื่อภยันตรายประการอื่นๆ ได้ผ่านพ้นไปแล้วนั้น ได้เวลาถึงสามปียังไม่มีใครทราบว่าบุคคลนั้นเป็นตายร้ายดีอย่างไร

- ถ้าบุคคลได้ไปจากถิ่นที่อยู่ และตราบเท่าเจ็ดปีไม่มีใครทราบแน่ว่าจะเป็นตายร้ายดีอย่างใด เมื่อพนักงานอัยการฤๅผู้ใดผู้หนึ่งซึ่งมีส่วนได้เสียร้องขอต่อศาล ศาลจะมีคำสั่งแสดงว่าบุคคลเช่นว่านั้นสาบสูญเสียแล้วก็ได้
- อนึ่งระยะเจ็ดปีข้างต้นนั้น ถ้ามีข้อความที่ควรเชื่อฟังได้ในครั้งหลังที่สุดแสดงให้เห็นว่า บุคคลผู้ไม่อยู่นั้นตกอยู่ในฐานที่จะเป็นอันตรายแก่ชีวิต เสมือนเช่นว่าเป็นผู้ไปในเรือเมื่ออับปางก็ดี ฤๅตกอยู่ในกลางสงครามก็ดี ให้ลดเวลาลงคงสามปี
