มาตรา 233
- ถ้าลูกหนี้ขัดขืนไม่ยอมใช้สิทธิเรียกร้อง หรือเพิกเฉยไม่ใช้สิทธิเรียกร้อง เป็นเหตุให้เจ้าหนี้ต้องเสียประโยชน์ไซร้ ท่านว่าเจ้าหนี้จะใช้สิทธิเรียกร้องนั้นในนามของตนเองแทนลูกหนี้เพื่อป้องกันสิทธิของตนในมูลหนี้นั้นก็ได้ เว้นแต่ในข้อที่เป็นการของลูกหนี้ส่วนตัวโดยแท้
