มาตรา 364
- ถ้าบุคคลหลายคนกระทำการอันบ่งไว้ในโฆษณา ท่านว่าเฉพาะแต่คนที่ทำได้ก่อนใครหมดเท่านั้น มีสิทธิจะได้รับรางวัล
- ถ้าบุคคลหลายคนกระทำการอันนั้นได้พร้อมกัน ท่านว่าแต่ละคนมีสิทธิจะได้รับรางวัลเป็นส่วนแบ่งเท่าๆกัน แต่ถ้ารางวัลนั้นมีสภาพแบ่งไม่ได้ก็ดี หรือถ้าตามข้อความแห่งคำมั่นนั้น บุคคลแต่คนเดียวจะพึงรับรางวัลก็ดี ท่านให้วินิจฉัยด้วยวิธีจับสลาก
- บทบัญญัติดั่งกล่าวมาในวรรคทั้งสองข้างต้นนั้น ท่านมิให้ใช้บังคับ ถ้าในโฆษณานั้นแสดงเจตนาไว้เป็นอย่างอื่น
