- บทบัญญัติแห่งมาตรา ๑๓๐ วรรคสองนั้น ท่านมิให้ใช้บังคับ ถ้าหากว่าขัดกับเจตนาอันผู้เสนอได้แสดง หรือหากว่าก่อนจะสนองรับนั้น คู่กรณีอีกฝ่ายหนึ่งได้รู้อยู่แล้วว่าผู้เสนอตายหรือตกเป็นผู้ไร้ความสามารถ
