- ความตกลงทำไว้ล่วงหน้าเป็นข้อความยกเว้นมิให้ลูกหนี้ต้องรับผิดเพื่อกลฉ้อฉล หรือความประมาทเลินเล่ออย่างร้ายแรงของตนนั้น ท่านว่าเป็นโมฆะ
