มาตรา 441
- ถ้าบุคคลจำต้องใช้ค่าสินไหมทดแทนเพื่อความเสียหายอย่างใดๆ เพราะเอาสังหาริมทรัพย์ของเขาไปก็ดี หรือเพราะทำของเขาให้บุบสลายก็ดี เมื่อใช้ค่าสินไหมทดแทนให้แก่บุคคลซึ่งเป็นผู้ครองทรัพย์นั้นอยู่ในขณะที่เอาไป หรือขณะที่ทำให้บุบสลายนั้นแล้ว ท่านว่าเป็นอันหลุดพ้นไปเพราะการที่ได้ใช้ให้เช่นนั้น แม้กระทั่งบุคคลภายนอกจะเป็นเจ้าของทรัพย์หรือมีสิทธิอย่างอื่นเหนือทรัพย์นั้น เว้นแต่สิทธิของบุคคลภายนอกเช่นนั้นจะเป็นที่รู้อยู่แก่ตน หรือมิได้รู้เพราะความประมาทเลินเล่ออย่างร้ายแรงของตน
