มาตรา 446
- ในกรณีทำให้เขาเสียหายแก่ร่างกายหรืออนามัยก็ดี ในกรณีทำให้เขาเสียเสรีภาพก็ดี ผู้ต้องเสียหายจะเรียกร้องเอาค่าสินไหมทดแทนเพื่อความที่เสียหายอย่างอื่นอันมิใช่ตัวเงินด้วยอีกก็ได้ สิทธิเรียกร้องอันนี้ไม่โอนกันได้ และไม่ตกสืบไปถึงทายาท เว้นแต่สิทธินั้นจะได้รับสภาพกันไว้โดยสัญญาหรือได้เริ่มฟ้องคดีตามสิทธินั้นแล้ว
- อนึ่งหญิงที่ต้องเสียหายเพราะผู้ใดทำผิดอาญาเป็นทุรศีลธรรมแก่ตน ก็ย่อมมีสิทธิเรียกร้องทำนองเดียวกันนี้
