มาตรา 450
- ถ้าบุคคลทำบุบสลาย หรือทำลายทรัพย์สิ่งหนึ่งสิ่งใด เพื่อจะบำบัดปัดป้องภยันตรายซึ่งมีมาเป็นสาธารณะโดยฉุกเฉิน ท่านว่าไม่จำต้องใช้ค่าสินไหมทดแทน หากความเสียหายนั้นไม่เกินสมควรแก่เหตุภยันตราย
- ถ้าบุคคลทำบุบสลาย หรือทำลายทรัพย์สิ่งหนึ่งสิ่งใด เพื่อจะบำบัดปัดป้องภยันตรายอันมีแก่เอกชนโดยฉุกเฉิน ผู้นั้นจะต้องใช้คืนทรัพย์นั้น
- ถ้าบุคคลทำบุบสลาย หรือทำลายทรัพย์สิ่งหนึ่งสิ่งใด เพื่อจะป้องกันสิทธิของตนหรือของบุคคลภายนอกจากภยันตรายอันมีมาโดยฉุกเฉินเพราะตัวทรัพย์นั้นเองเป็นเหตุ บุคคลเช่นว่านี้หาต้องรับผิดใช้ค่าสินไหมทดแทนไม่ หากความเสียหายนั้นไม่เกินสมควรแก่เหตุ แต่ถ้าภยันตรายนั้นเกิดขึ้นเพราะความผิดของบุคคลนั้นเองแล้ว ท่านว่าจำต้องรับผิดใช้ค่าสินไหมทดแทนให้
