- ถ้าหนี้มีอยู่เป็นคุณแก่บุคคลผู้ใดในมูลอย่างหนึ่งอย่างใด ดังจะกล่าวต่อไปนี้ บุคคลผู้นั้นย่อมมีบุริมสิทธิเหนือทรัพย์สินทั้งหมดของลูกหนี้ คือ
