มาตรา 323
- ถ้าวัตถุแห่งหนี้เป็นอันให้ส่งมอบทรัพย์เฉพาะสิ่ง ท่านว่าบุคคลผู้ชำระหนี้จะต้องส่งมอบทรัพย์ตามสภาพที่เป็นอยู่ในเวลาที่จะพึงส่งมอบ

- [I] If the subject of an obligation is the delivery of a specific thing, the person making performance must deliver the thing in condition in which it is at the same time when delivery is to be made.
