มาตรา 46
  • ภูมิลำเนาของข้าราชการ ได้แก่ถิ่นอันเป็นที่ทำการตามตำแหน่งหน้าที่ หากมิใช่เป็นตำแหน่งหน้าที่ชั่วคราวชั่วระยะเวลาหรือเป็นเพียงแต่งตั้งไปเฉพาะการครั้งเดียวคราวเดียว
