Article 306.
  • A person who has an obligation in his favour arising from any of the causes mentioned below has a preferential right in the whole property of the debtor: -
  • (1) Expenses for the common benefit;
  • (2) Funeral expenses;
  • (3) Wages of employees;
  • (4) Supplies of daily necessaries.

Article 307.
  • [I] A preferential right for expenses for the common benefit exists with regard to expenses relating to the preservation, liquidation , or distribution of the property of the debtor which has been done for the common benefit of all the creditors.
  • [II] With regard to any of those expenses of the preceding Paragraph which have not been of benefit to all the creditors the preferential right exists only against the creditors who have profited by the expenses.

Article 308.
  • [I] The preferential right for funeral expenses exists with regard to such funeral expenses as are suitable to the social standing and position enjoyed by the debtor during his life.
  • [II] The preferential right of the preceding Paragraph equally exists with regard to the expenses of a funeral incurred for a relative who the debtor is bound to support or a member of the household according to his or her social standing.

  • The preferential right for wages of employees exists with regard to the wages for the last six months of the employees of the debtor; but the amount thereof must not exceed fifty yen.

Article 310.
  • The preferential right for the supply of daily necessaries exists with regard to articles of food and drink, wood and charcoal , and oil and petroleum supplied for the last six months and necessary for the subsistence of the debtor, the relatives who live with him and whom he is bound to support and the members of his household, as well as for the subsistence of his men-servants and maidservants.
