DIVISION IV. EFFECTS OF OBLIGATIONS.

TITLE I. General Provisions.

Section 218.
  • [I] An obligation is binding upon the parties to it.
  • [II] It is also binding upon the heirs of the parties to the extent provided by the laws on Inheritance.
  • [III] It cannot affect the rights of third persons.

  • A party to a contract who promises that a third person shall make a prestation is bound to make compensation if such prestation is not made.

  • [I] If a party to a contract agrees to make a prestation to a third person the other party is entitled to claim that the prestation be made to such third person.
  • [II] The third person also can claim directly performance from the debtor.

  • If it is agreed in a contract that a party shall make a prestation to a third person, the parties to such a contract cannot modify it after the third person has notified in writing to the debtor his intention to take the benefit of the contract.
