Chapter VI. Subagency.
Section 949.
- The agent cannot appoint a subagent, unless he be allowed by the principal to do so, or unless by custom a subagent may be appointed.

Section 950.
- An agent who has appointed a subagent although he was not allowed by the principal or by custom to do so is liable for all the acts done by that subagent in such capacity.

- The agent who has lawfully appointed a subagent is not liable to the principal for the acts done by the subagent unless the principal proves that the agent has not selected the subagent with such care as may be expected from a person of ordinary prudence.

- If the discretion left to the agent for the appointment of a subagent has been limited to persons designated by name by the principal, the agent is not liable for the acts done by any such subagent.
