Chapter VII. Particular Kinds of Obligations.

Title XXIII. Production of Things.

  • A person who has a claim against the possessor of a thing in respect of the thing, or wishes to ascertain whether he has such a claim, may, if the inspection of the thing is of interest to him for this reason, require the possessor to produce the thing for his inspection or to permit his inspection.
  • A person who has a legal interest in the examination of a document in the possession of another may demand the possessor to permit him to examine it, if the document is made in his interest, or if in the document a legal relation existing between himself and another is recorded, or if the document contains the negotiations of any juristic act which have been carried on between him and another person, or between one of them and a common intermediary.
  • [I] In the cases provided for by 809, 810 the production shall be made in the place where the thing to be produced is. Hither party may require production in some other place if a grave reason exists.
  • [II] The risk and the cost shall be borne by the person asking for the production. The possessor may refuse production until the other party advances to him the costs and gives security against the risk.
