มาตรา 764
- เมื่อจะบังคับจำนำ ผู้รับจำนำต้องจดหมายบอกกล่าวไปยังลูกหนี้ก่อน ให้ชำระหนี้และอุปกรณ์ภายในเวลาอันควรซึ่งกำหนดให้ในคำบอกกล่าวนั้น
- ถ้าลูกหนี้ละเลยไม่ปฏิบัติตามคำบอกกล่าว ผู้รับจำนำชอบที่จะเอาทรัพย์สินซึ่งจำนำออกขายได้ แต่ต้องขายทอดตลาด
- อนึ่ง ผู้รับจำนำต้องมีจดหมายบอกกล่าวไปยังผู้จำนำบอกเวลาและสถานที่ซึ่งจะขายทอดตลาดด้วย

- [I] On enforcement of the pledge the pledgee must first notify the debtor in writing to perform the obligation and accessories within a reasonable time to be fixed in the notice.
- [II] If the debtor fails to comply with the notice, the pledgee is entitled to sell the pledged property, but only by public auction.
- [III] The pledgee must notify the pledgor in writing of the time and place of the auction.
