《Comments》
The most plausible model for this section would be:
- Japanese Civil Code (1896,98), Art.4:
- [I] A minor must obtain the consent of his legal representative to do juristic acts, with the exception of acts by which he simply acquires rights or avoids duties.
- [II] Acts contrary to the provisions of the preceding paragraph may be annulled.
The other miscellaneous source is as follows:
- Swiss Civil Code (1907), Sec.19:
- [I] Persons with capacity of judgment, but minors or incapacitated, can obligate themselves in their transactions only with the consent of their legal representatives. Without this consent they may accept voluntary benefits and exercise rights belonging to them by reason of their personality.
- [II] They are responsible for damage caused by their unlawful acts.
