มาตรา 122
- การอันจะเป็นโมฆียะกรรมเพราะกลฉ้อฉลนั้น ต่อเมื่อถึงขนาดซึ่งถ้ามิได้มีกลฉ้อฉลเช่นนั้น อันนั้นก็คงจะมิได้ทำขึ้นเลย

- ความยินยอมของคู่สัญญาฝ่ายหนึ่ง อันอีกฝ่ายหนึ่งลวงเอาได้เพราะกลฉ้อฉลนั้น ย่อมเป็นยินยอมบกพร่อง แต่หากพิเคราะห์ด้วยว่า ถ้ามิได้ใช้กลฉ้อฉลถึงเพียงนั้น ผู้คู่สัญญาคนก่อนก็จะไม่ได้ให้ความยินยอม
