มาตรา 217
- ลูกหนี้จะต้องรับผิดชอบในความเสียหายบรรดาที่เกิดแต่ความประมาทเลินเล่อในระหว่างเวลาที่ตนผิดนัด ทั้งจะต้องรับผิดชอบในการที่การชำระหนี้กลายเป็นพ้นวิสัย เพราะอุบัติเหตุอันเกิดขึ้นในระหว่างเวลาที่ผิดนัดด้วย เว้นแต่ความเสียหายนั้นถึงแม้ว่าตนจะได้ชำระหนี้ทันเวลากำหนดก็คงจะต้องเกิดมีอยู่นั้นเอง

- A debtor is responsible for all negligence during his default. He is also responsible for impossibility of performance arising accidentally during the default, unless the injury would have arises even if he had performed in due time.

The most plausible model for this section would be:
- German Civil Code (1896), Sec.287;
- A debtor is responsible for all negligence during his default. He is also responsible for impossibility of performance arising accidentally during the default, unless the injury would have arisen even if he had performed in due time.
The other miscellaneous sources are as follows:
- Civil Code of Brazil (1916), Art.957;
- The debtor in default (em mora) responds for the impossibility of the prestation, although such impossibility results from fortuitous event or vis major, if the same occurred during the delay (atrazo) ; unless it is proved that he was without fault, or that the damage would have occurred (sobreviria) although the obligation had been opportunely performed (Art. 1058).

- [I] Der Schuldner haftet im allgemeinen für jedes Verschulden.
- [II] Das Maß der Haftung richtet sich nach der besonderen Natur des Geschäftes und wird insbesondere milder beurteilt, wenn das Geschäft für den Schuldner keinerlei Vorteil bezweckt.
- [III] Im übrigen finden die Bestimmungen über das Maß der Haftung bei unerlaubten Handlungen auf das vertragswidrige Verhalten entsprechende Anwendung.
