มาตรา 360
- บทบัญญัติแห่งมาตรา ๑๓๐ วรรคสองนั้น ท่านมิให้ใช้บังคับ ถ้าหากว่าขัดกับเจตนาอันผู้เสนอได้แสดง หรือหากว่าก่อนจะสนองรับนั้น คู่กรณีอีกฝ่ายหนึ่งได้รู้อยู่แล้วว่าผู้เสนอตายหรือตกเป็นผู้ไร้ความสามารถ

- The provisions of Section 130 paragraph 2 do not apply, if the offerer has declared a contrary intention, or if before accepting the other party had notice of the fact of his death or loss of capacity.

- The provisions of Art. 97, Paragraph 2, do not apply in case the offerer has expressed a contrary intention or the other party had knowledge of the fact of his death or the loss of capacity.
