มาตรา 443
- ในกรณีทำให้เขาถึงตายนั้น ค่าสินไหมทดแทนได้แก่ค่าปลงศพ รวมทั้งค่าใช้จ่ายอันจำเป็นอย่างอื่นๆอีกด้วย
- ถ้ามิได้ตายในทันที ค่าสินไหมทดแทนได้แก่ค่ารักษาพยาบาล รวมทั้งค่าเสียหายที่ต้องขาดประโยชน์ทำมาหาได้เพราะไม่สามารถประกอบการงานนั้นด้วย
- ถ้าว่าเหตุที่ตายลงนั้นทำให้บุคคลคนหนึ่งคนใดต้องขาดไร้อุปการะตามกฎหมายไปด้วยไซร้ ท่านว่าบุคคลคนนั้นชอบที่จะได้รับค่าสินไหมทดแทนเพื่อการนั้น

- [I] In the case of causing death, compensation shall include funeral and other necessary expenses.
- [II] If death did not ensue immediately, compensation shall include in particular expenses for medical treatment and damages for the loss of earning on account of disability to work.
- [III] If on account of the death any person has been deprived of his legal support, he is entitled to compensation therefore.

The most plausible model for this section would be:
- Schweizerisches Obligationenrecht (1911), Art.45;
- [I] Im Falle der Tötung eines Menschen sind die entstandenen Kosten, insbesondere diejenigen der Bestattung, zu ersetzen.
- [II] Ist der Tod nicht sofort eingetreten, so muss namentlich auch für die Kosten der versuchten Heilung und für die Nachteile der Arbeitsunfähigkeit Ersatz geleistet werden.
- [III] Haben andere Personen durch die Tötung ihren Versorger verloren, so ist auch für diesen Schaden Ersatz zu leisten.
