มาตรา 591
- ถ้าความชำรุดบกพร่องหรือความชักช้าในการที่ทำนั้นเกิดขึ้นเพราะสภาพแห่งสัมภาระซึ่งผู้ว่าจ้างส่งให้ก็ดี เพราะคำสั่งของผู้ว่าจ้างก็ดี ท่านว่าผู้รับจ้างไม่ต้องรับผิด เว้นแต่จะได้รู้อยู่แล้วว่าสัมภาระนั้นไม่เหมาะ หรือคำสั่งนั้นไม่ถูกต้อง และมิได้บอกกล่าวตักเตือน

- If the defect or the delay in the work originates from the nature of the materials supplied by the employer, or from instructions given by him, the contractor is not liable, unless the contractor knew of the unfitness of the materials or the impropriety of instructions, and did not give notice of it.
