มาตรา 39
- สภาพบุคคลย่อมเริ่มแต่เมื่อคลอดแล้วอยู่รอดเป็นทารก และสุดสิ้นลงเมื่อตาย
- ทารกในครรภ์มารดา สามารถจะมีสิทธิบางอย่างที่กฎหมายบ่งไว้โดยเฉภาะ หากว่าภายหลังเกิดมารอดอยู่
