มาตรา 722
- ถ้าทรัพย์สินได้จำนองแล้ว และภายหลังที่จดทะเบียนจำนอง มีจดทะเบียนภารจำหรือทรัพย์สิทธิอย่างอื่น โดยผู้รับจำนองมิได้ยินยอมด้วยไซร้ ท่านว่าสิทธิจำนองย่อมเป็นใหญ่กว่าภารจำหรือทรัพย์สิทธิอย่างอื่นนั้น หากว่าเป็นที่เสื่อมเสียแก่สิทธิของผู้รับจำนองในเวลาบังคับจำนอง ก็ให้ลบสิทธิที่กล่าวหลังนั้นเสียจากทะเบียน

- When a property has been mortgaged and a servitude or other real right is registered after the registration of the mortgage without the consent of the mortgagee, the mortgage has priority over the servitude or other real right and the latter will be erased from the register where its existence prejudices the rights of the mortgagee on the enforcement of the mortgage.
