ถ้าผู้ค้ำประกันต้องรับผิดร่วมกันกับลูกหนี้ ท่านว่าผู้ค้ำประกันย่อมไม่มีสิทธิดังกล่าวไว้ในมาตรา ๖๘๘, ๖๘๙ และ ๖๙๐
