Section 138.
- [I] Whenever the performance or the extinction of an obligation depends either on the occurrence or on the non-occurrence of an uncertain event, the obligation is said to be conditional.
- [II] An event is said to be uncertain when there is a possibility of its not occurring.

- An obligation subject to an unlawful condition, or to a condition contrary to public policy or to the safety of persons or property is void.
