DRAFT: CIVIL AND COMMERCIAL CODE FOR KINGDOM OF SIAM. (April 1924)

The following text of the Draft for the Book III of the "Civil and Commercial Code for the Kingdom of Siam" was reconstructed from the Documents in Vols. 40, 41, 42, 43, 86, 87, 88, and 89 of “The Archives of the History of Thai Codification”. Unfortunately, the the Archives do not contain its original copy.

The initial concept of the Draft developed by the French commissioners covered the general principles of civil law, the general rules of obligations, and the part of specific contracts all together in a single volume.

By September 1920, however, the Commission of Codification decided to separate the part for the general principles from other parts as a "Book I on General Principles" (see the Thai translation of the Draft in the archive Vol.71).

By September 1921, furthermore, the Commission decided to separate the Book in Obligations between the general part as a "Book II" and the specific part for contracts as a "Book III" (see the Thai translation of the Draft in the archive Vol.73).

In the memorandum of 19th December 1921 submitted by Mr. René Guyon, he proposed the Books I and II to be promulgated soon, separately from the still unfinished Book III. Apparently, his proposal was approved, but shortly before the actual promulgation of the Books I and II, the Commission decided
