มาตรา 689
- ถึงแม้จะได้เรียกให้ลูกหนี้ชำระหนี้ดั่งกล่าวมาในมาตราก่อนนั้นแล้วก็ตาม ถ้าผู้ค้ำประกันพิศูจน์ได้ว่าลูกหนี้นั้นมีทางที่จะชำระหนี้ได้ และการที่จะบังคับให้ลูกหนี้ชำระหนั้นจะไม่เป็นการยากไซร้ ท่านว่าเจ้าหนี้จะต้องบังคับการชำระหนี้รายนั้น เอาจากทรัพย์สินของลูกหนี้ก่อน

- Even after the debtor has been called upon as provided in the foregoing section, if the surety can prove that the debtor has the means to perform and that execution would not be difficult, the creditor must first make execution against the property of the debtor.
