มาตรา 408
- บุคคลดั่งจะกล่าวต่อไปนี้ไม่มีสิทธิจะได้รับคืนทรัพย์ คือ
- (๑) บุคคลผู้ชำระหนี้อันมีเงื่อนเวลาบังคับเมื่อก่อนถึงกำหนดเวลานั้น
- (๒) บุคคลผู้ชำระหนี้ซึ่งขาดอายุความแล้ว
- (๒) บุคคลผู้ชำระหนี้ตามหน้าที่ศีลธรรม หรือตามควรแก่อัธยาศัยในสมาคม

- The following persons are not entitled to restitution:
- (1) A person who performs an obligation subject to a time clause before the time has arrived;
- (2) A person who performs an obligation which has been barred by prescription;
- (3) A person who performs an obligation in compliance with a moral duty or with the requirements of social propriety.

- (๒) บุคคลผู้ชำระหนี้ซึ่งสิ้นอายุความแล้ว
- บุคคลซึ่งกล่าวต่อไปนี้ ไม่มีสิทธิจะได้คืนสินใช้ คือ

- [I] Wer eine Nichtschuld freiwillig bezahlt, kann das Geleistete nur dann zurückfordern, wenn er nachzuweisen vermag, dass er sich über die Schuldpflicht im Irrtum befunden hat.
- [II] Ausgeschlossen ist die Rückforderung, wenn die Zahlung für eine verjährte Schuld oder in Erfüllung einer sittlichen Pflicht geleistet wurde.
- [III] Vorbehalten bleibt die Rückforderung einer bezahlten Nichtschuld nach Schuldbetreibungs- und Konkursrecht.
