มาตรา 17
- ถ้าบุคคลหลายคนถึงชีวิตันตรายในเหตุภยันตรายร่วมกัน และเป็นการพ้นวิสัยที่จะกำหนดได้ว่าคนไหนถึงชีวิตันตรายก่อนหลังไซร้ ท่านให้สันนิษฐานไว้ก่อนว่าตายพร้อมกัน

- When several persons have perished in a common peril, and it is not possible to determine which of them perished first, they will be presumed to have died simultaneously.

The most plausible model for this section would be:
- Civil Code of Brazil (1916), Art.11:
- If two or more persons should decease on the same occasion, it not being possible to determine which of them perished first, they will be presumed to have died simultaneously.

- Swiss Civil Code (1907), Art.32:
- He who in the exercise of a right relies upon the fact that a person may be living or dead, or was alive at a certain time, or survived another person, must present the proof thereof. In case it cannot be proven that of several deceased persons that one survived the others, then all are presumed to have died simultaneously.
