มาตรา 489
- ถ้าผู้ซื้อถูกผู้รับจำนองหรือบุคคลผู้เรียกร้องเอาทรัพย์สินที่ขายนั้นขู่ว่าจะฟ้องเป็นคดีขึ้นก็ดี หรือมีเหตุอันควรเชื่อว่าจะถูกขู่เช่นนั้นก็ดี ผู้ซื้อก็ชอบที่จะยึดหน่วงราคาไว้ทั้งหมดหรือบางส่วนได้ดุจกันจนกว่าผู้ขายจะได้บำบัดภัยอันนั้นให้สิ้นไป หรือจนกว่าผู้ขายจะหาประกันที่สมควรให้ได้

- The buyer is also entitled to withhold the price wholly or partly, if he is as good reason to believe that he is about to be threatened, with an action by a mortgagee or by a person claiming the property sold, until the seller has caused the danger with which he is threatened to cease, or until the seller has given proper security.

The most plausible model for this section would be:
- French Civil Code (1804), Art.1653;
- If the purchaser be harassed or has a just ground for fearing he shall be troubled by an action either of mortgage, or of counter-claim, he may suspend the payment of the price until the seller have put an end to such harassment, unless the latter prefer giving security, or unless it have been stipulated, that notwithstanding such annoyance, the purchaser shall pay.
