มาตรา 531
- อันผู้ให้จะเรียกถอนคืนการให้เพราะเหตุผู้รับประพฤติเนรคุณนั้น ท่านว่าอาจจะเรียกได้แต่เพียงในกรณีดั่งจะกล่าวต่อไปนี้
- (๑) ถ้าผู้รับได้ประทุษร้ายต่อผู้ให้เป็นความผิดฐานอาญาอย่างร้ายแรงตามประมวลกฎหมายลักษณะอาญา หรือ
- (๒) ถ้าผู้รับได้ทำให้ผู้ให้เสียชื่อเสียง หรือหมิ่นประมาทผู้ให้อย่างร้ายแรง หรือ
- (๓) ถ้าผู้รับได้บอกปัดไม่ยอมให้สิ่งของจำเป็นเลี้ยงชีวิตแก่ผู้ให้ในเวลาที่ผู้ให้ยากไร้และผู้รับยังสามารถจะให้ได้
Section 531. (Draft in English from Vol.93)
- The donor can claim revocation of a gift for an act of ingratitude only in the following cases:
- (1) If the donee committed a serious criminal offence punishable under the Penal Code against the donor, or
- (2) If the donee seriously defamed or insulted the donor, or
- (3) If the donee refused the donor who is in need of the necessaries of life while he was able to supply them.
