มาตรา 680
- อันว่าค้ำประกันนั้น คือสัญญาซึ่งบุคคลภายนอกคนหนึ่ง เรียกว่าผู้ค้ำประกัน ผูกพันตนต่อเจ้าหนี้คนหนึ่งเพื่อชำระหนี้ในเมื่อลูกหนี้ไม่ชำระหนี้นั้น
- อนึ่งสัญญาค้ำประกันนั้น ถ้ามิได้มีหลักฐานเป็นหนังสืออย่างใดอย่างหนึ่งลงลายมือชือผู้ประกันเป็นสำคัญ ท่านว่าจะพอ้งร้องให้บังคับคดีหาได้ไม่

- [I] Suretyship is a contract whereby a third person, called the surety, binds himself to a creditor to satisfy an obligation in the event that the debtor fails to perform it.
- [II] A contract of suretyship is not enforceable by action unless there be some written evidence signed by the surety.
