มาตรา 756
- การที่จะตกลงกันไว้เสียแต่ก่อนเวลาหนี้ถึงกำหนดชำระ เป็นข้อความอย่างใดอย่างหนึ่งว่า ถ้าไม่ชำระหนี้ ให้ผู้รับจำนำเข้าเป็นเจ้าของทรัพย์สินจำนำ หรือให้จัดการแก่ทรัพย์สินนั้นเป็นประการอื่นนอกจากตามบทบัญญัติทั้งหลายว่าด้วยการบังคับจำนำนั้นไซร้ ข้อตกลงเช่นนั้นท่านว่าไม่สมบูรณ์
Section 756. (Draft in English from Vol.93)
- Before the obligation is due, any agreement that the pledgee shall, in case of non-performance, become the owner of the pledged property or disposed of it otherwise than in accordance with the provisions concerning Enforcement of Pledge, shall be invalid.
