ถ้าผู้ว่าจ้างเป็นผู้จัดหาสัมภาระส่ง และการที่จ้างทำนั้นพังทลายหรือบุบสลายลงก่อนได้ส่งมอบกันถูกต้องไซร้ ท่านว่าความวินาศนั้นตกเป็นพับแก่ผู้ว่าจ้าง หากความวินาศนั้นมิได้เป็นเพราะการกระทำของผู้รับจ้าง
ในกรณีเช่นว่านี้ สินจ้างก็เป็นอันไม่ต้องใช้ เว้นแต่ความวินาศนั้นเป็นเพราะการกระทำของผู้ว่าจ้าง

[I] If the materials have been supplied by the employer, and the work is destroyed or damaged before due delivery, the employer bears the loss provided that such loss is not caused by any act of the contractor.
[II] In such case no remuneration is payable unless the loss is caused by any act of the employer.
