มาตรา 453
  • อันว่าซื้อขายนั้น คือสัญญาซึ่งบุคคลฝ่ายหนึ่งเรียกว่าผู้ขาย โอนกรรมสิทธิ์แห่งทรัพย์สินให้แก่บุคคลอีกฝ่ายหนึ่ง เรียกว่าผู้ซื้อ และผู้ซื้อตกลงว่าจะใช้ราคาทรัพย์สินนั้นให้แก่ผู้ขาย

The most plausible model for this section would be:

  • Swiss Federal Code of Obligation (1881), Art.229:
    • Durch den Kaufvertrag verpflichtet sich der Verkäufer dem Käufer den Kaufgegenstand zu vollem Rechte und Genüsse zu übergeben, und der Käufer, dem Verkäufer den verabredeten Preis zu bezahlen.
  • Schweizerisches Obligationenrecht (1911), Art.184:
    • [I] Durch den Kaufvertrag verpflichtet sich der Verkäufer, dem Käufer den Kaufgegenstand zu übergeben und ihm das Eigentum daran zu verschaffen, und der Käufer, dem Verkäufer den Kaufpreis zu bezahlen.
    • [II] Sofern nicht Vereinbarung oder Übung entgegenstehen, sind Verkäufer und Käufer verpflichtet, ihre Leistungen gleichzeitig - Zug um Zug - zu erfüllen.
    • [III] Der Preis ist genügend bestimmt, wenn er nach den Umständen bestimmbar ist.

  • French Civil Code (1804), Art. 1582:
    • [I] A sale is an agreement by which one person is bound to deliver a thing, and another to pay for it
    • [II] It may be made by authentic act, or under private signature.
  • German Civil Code (1896), Sec. 433:
    • [I] By a contract of sale the seller of a thing is bound to deliver the thing to the purchaser and to transfer ownership of the thing. The seller of a right is bound to transfer the right to the purchaser, and if the right involves the possession of a thing, to deliver the thing.
    • [II] The purchaser is bound to pay to the seller the purchase price agreed upon and to take delivery of the thing purchased.
  • Japanese Civil Code (1896, 98), Art. 555:
    • A sale takes effect when one of the parties agrees to transfer a property right to the other party, and the latter agrees to pay him the purchase money for it.
