มาตรา 466
- ในการซื้อขายอสังหาริมทรัพย์นั้น หากว่าได้ระบุจำนวนเนื้อที่ทั้งหมดไว้ และผู้ขายส่งมอบทรัพย์สินน้อยหรือมากไปกว่าที่ได้สัญญาไซร้ ท่านว่าผู้ซื้อจะปัดเสีย หรือจะรับเอาไว้และใช้ราคาตามส่วนก็ได้ ตามแต่จะเลือก
- อนึ่ง ถ้าขาดตกบกพร่องหรือล้ำจำนวนไม่เกินกว่าร้อยละห้าแห่งเนื้อที่ทั้งหมดอันได้ระบุไว้นั้นไซร้ ท่านว่าผู้ซื้อจำต้องรับเอาและใช้ราคาตามส่วน แต่ว่าผู้ซื้ออาจจะเลิกสัญญาเสียได้ในเมื่อขาดตกบกพร่องหรือล้ำจำนวนถึงขนาด ซึ่งหากผู้ซื้อได้ทราบก่อนแล้วคงจะมิได้เข้าทำสัญญานั้น
Section 466. (Draft in English from Vol.93)
- [I] In a sale of immovable property where the total area is specified and the seller delivers the property less or more than he contracted for, the buyer has the option either to reject or accept it and pay the proportionate price.
- [II] If the deficiency or excess does not exceed five per cent of the total area so specified the buyer is bound to accept it and pay the proportionate price, provided that the buyer can rescind the contract if the deficiency or excess is such that had he known of it he would not have entered into the contract.

- [I] If the sale of an immoveable have been made with indication of extent, at the rate of so much measure, the seller is bound to deliver to the purchaser, if he require it, the quantity indicated in the contract.
- [II] And if the thing is impossible to him, or if the purchaser do not require it, the seller is compelled to suffer a proportional diminution of the price.

- If on the contrary, in the case of the preceding article, there be found an extent greater than that expressed in the contract, the purchaser has the election to supply the remainder of the price, or to relinquish the contract, if the excess be a twentieth beyond the extent declared.

- In all other cases,
- Whether sale be made of a certain and limited property,
- Whether it have for its object funds distinct and separate,
- Whether it commence by the measure, or by designation of the object sold followed by measure,
- The expression of such measure does not give place to any additional price in favour of the seller, to any diminution of the price for less measure, except when the difference between the real measure and that expressed in the contract is a twentieth more or less, regard being had to the total value of the objects sold, if there be no contrary stipulation.
- In all other cases,

- In the case in which, according to the preceding article, there is ground for augmenting the price on account of excess of measure, the purchaser has the election either to recede from the contract, or to furnish the additional price, and this with interest if he have kept the immoveable.
