The most plausible model for this section would be:
- Sale of Goods Act (1893), Sec. 32 (1):
- Where, in pursuance of a contract of sale, the seller is authorised or required to send the goods to the buyer, delivery of the goods to a carrier, whether named by the buyer or not, for the purpose of transmission to the buyer, is prima facie deemed to be a delivery of the goods to the buyer.
The other relevant sources are as follows:
- German Civil Code (1896), Sec. 447:
- [I] If at the request of the purchaser the seller transmits the thing sold to a place other than the place of performance, the risk passes to the purchaser as soon as the seller has delivered the thing to the forwarder, freighter, or other person or institution designated to carry out the transmission.
- [II] If the purchaser has given special instructions as to the manner of forwarding, and the seller deviates from the instructions without urgent reason, the seller is responsible to the purchaser for any damage arising therefrom.
- Swiss Federal Code of Obligation (1881), Art.203:
- Muss die veräusserte Sache versendet werden, geht der Besitz auf den Erwerber über, sobald dieser die Sache durch einen Stell-Vertreter oder persönlich in Empfang nimmt.
